Victorian Government to Introduce Psychosocial Regulations
The Victorian Government have recently announced their intentions to introduce the new psychosocial regulations in 2025. This will create new obligations for employers. The new regulations are being introduced in response to recommendations made by the Royal Commission into Victoria’s Mental Health System and the Productivity Commission Inquiry into Mental health.
It is understood that the regulations will also be accompanied by a compliance code, which will assist to guide employers on how to meet their duties under the proposed regulations.
The draft regulations were released for public comment in in February 2022, and expressly required employers to develop written prevention plans to address hazards and risks, necessary control measures, implementation and consultation arrangements.
WorkSafe health and safety executive director Sam Jenkin said the changes will “send a clear message that employers must treat psychosocial hazards just as seriously as they do physical hazards, while also supporting them with the tools they need to create mentally healthy workplaces”.
It is anticipated that the finalised Amendment regulations will be made in October 2025, and take effect on 1st December 2025.
